Dog Training Services Agreement

This Agreement between Cyndi Picano of VIP Pet Services
__________________ (hereinafter referred to as “Client”) and Cyndi Picano acting as agent for VIP Pet Services (hereinafter known as “Trainer”) pertains to the following:

For good and valuable consideration, the parties agree as follows:
Training Fees:

a. Client agrees to pay Trainer a nonrefundable fee in the amount of $85.00 for first session (approximate length 1 hour and $85.00 for each follow-up session (approximate length 1 hour). OR
b. Client agrees to pay Trainer a nonrefundable fee in the amount of $510.00 for a package of 6 sessions (approximate length 1 hour each) to be paid at first session. All sessions must be completed within 90 days from the date of commencement of contract or they will be forfeited.

Services: Trainer agrees to provide private lessons for Client and Dog on a lesson-by-lesson basis, the goal being to teach Client how to train and work with Dog. These lessons will take place at Client's home. Trainer will make every reasonable effort to help Client achieve training and behavior modification goals but makes no guarantee of Dog's performance or behavior as a result of providing professional animal behavior consultation. Client understands that he/she and members of the household must follow Trainer's instructions without modification, work with dog daily as recommended, and constantly reinforce training being given to Dog.

Cancellation Policy: If Client fails to give at least 24 hours cancellation notice, or is not present at time of scheduled client appointment, session fees are still due. For a package deal, the session will still be counted as one session.

Liability: If Dog causes property damage, or bites or injures any dog, animal or person (including but not limited to Trainer and Trainer's agents), during or after the term of this Agreement, then Client agrees to pay all resulting losses and damages suffered or incurred, and to defend and indemnify Trainer and Trainer's agents from any resulting claims, demands, lawsuits, losses, costs or expenses, including attorney fees. If Dog is injured in a fight or in any other manner during or after the term of the Agreement, Client assumes the risk and agrees that Trainer should not be held responsible for any resulting injuries, losses, damages, costs or expenses.

At Trainer's sole election, Trainer's duties hereunder shall terminate if (a) in Trainer's sole judgment Dog is dangerous or vicious to Trainer or any other person or animal, or interferes with the training of other dogs, or (b) Client breaches any term or condition of this Agreement. Upon termination in accordance with the foregoing, Trainer's duties shall terminate but all other provisions of this Agreement shall continue in full force and effect.

This Agreement is binding upon Client, spouse of Client, and children of Client. This Agreement supersedes all prior discussions, representations, warranties and agreements of the parties, and expresses the entire agreement between Client and Trainer regarding the matters described above. The parties confirm that, except for that which is specifically written in this Agreement, no promises, representations or oral understandings have been made with regard to Dog or anything else. Without limiting the generality of the foregoing, Client acknowledges that Trainer has not represented, promised, guaranteed or warranted that Dog will never bite, that Dog will not be dangerous or vicious in the future, that Dog will not exhibit other behavioral problems, or that the results of the training will last for any particular amount of time. This Agreement may be amended only by a written instrument signed by both Client and Trainer.

Terms & Conditions Service Contract

Terms and Conditions
This is our service contract. Please read all the terms and conditions carefully.

1. Reserving a Booking & Profiles: Clients must use the online system to book their visits. We require a 24 hour notice to book services. If last minute service is provided, then a $5.00 additional charge will be applied. We also require that you make sure pet profiles are up to date and complete. The information in the system is what we rely on for the most up to date care instructions for your pet(s). Any questions, concerns or issues are to be routed through our business office. Call or Text 704-875-8341. It is against our policies for our dog handling employees to give out their phone number or answer/handle any scheduling, billing or any other thing that is outside of their role of walking your pet.

2. Payment Policy: We require a credit card to be on file in our online system. All invoices are run on Mondays of each week for that week's bookings.

3. Other fees for additional services or circumstances may apply. Example of such: excessive cleaning or extended visits may be needed. In that case additional service charges will apply.

4. *Cancellation Policy: A 24 hour notice must be given for all cancellations and you go through your calendar on our online system to cancel services. If client does not give 24 hour notice, then we will charge for original booked visit(s). If client does give 24 hours notice, then a credit for cancelled booking(s) will be applied to next invoice.

5. Keys: Two (2) copies of keys are required at time of consultation. If client does not provide two (2) copies then we will make a copy and a $5.00 fee will be charged.

6. VIP Pet Services Enterprises Inc. will use the care instructions YOU enter in our booking software. VIP Pet Services is authorized to perform care and services as outlined on this contract and the pet care instructions in our booking system.

7. IF Client has other parties caring for pets at the same time VIP Pet Services is contracted, VIP Pet Services is NOT responsible or liable for ANY actions or care those parties give. We are only responsible for care given on our scheduled contracted visits.

8. *Client authorizes this signed contract to be valid approval for future services of any purpose provided by this contract permitting VIP Pet Services to accept telephone, text and email reservations for service and enter premises without additional signed contracts or written authorization.

9. VIP Pet Services is also authorized by Client to seek emergency veterinary care with release from all liabilities related to transportation, treatment, and expense.

10. Should specified veterinarian be unavailable, VIP PET Services is authorized to approve medical and/or emergency treatment (excluding euthanasia) as recommended by a veterinarian. Client agrees to reimburse VIP Pet Services for expenses incurred, plus any additional fee for attending to this need or any expenses incurred for any other home/food/supplies needed and credit card on file will be charged.

11. VIP Pet Services is free from all liability when client instructions include leaving pets in backyard, using Pet Doors or letting cats outdoors as a part of care.

12. VIP Pet Services reserves the right to photograph your pet(s) and use those photos on our website and other forms of advertising.

13. In the event of inclement weather or natural disaster, VIP Pet Services is entrusted to use best judgment in caring for pet(s) and home. VIP Pet Services will be held harmless for consequences related to such decisions.

14. VIP Pet Services agrees to provide the services stated in this contract as well as the care instructions in pet & client profiles in our online booking software in a reliable, caring and trustworthy manner. In consideration of these services, and as an express condition thereof, the client expressly waives and relinquishes any and all claims against VIP Pet Services except those arising from negligence or willful misconduct on the part of the VIP Pet Services.

15. All pets are to be currently vaccinated. Should Dog Handler be bitten or otherwise exposed to any disease or ailment received from Client's animal which has not been properly and currently vaccinated, it will be the client's responsibility to pay all costs and damages incurred by the victim.

16. VIP Pet Services reserves the right to terminate this contract at any time before or during its Term. If VIP Pet Services in its sole discretion, determines that Client's pet poses a danger to health or safety of Dog Handler and concerns prohibit Dog Handler from caring for pet, Client will be notified immediately.

17. It is expressly understood and agreed that VIP Pet Services shall not be held responsible for any damage to my property, or that of others, caused by my pet(s) during the period in which they are in VIP Pet Services care. The utmost care will be given in watching both your pet(s) and your home. However, due to the extreme unpredictability of animals, we cannot accept responsibility for any mishaps of any extraordinary or unusual nature (i.e. biting, furniture damage, accidental death, etc.) or any complications in administering medications to the animal. Nor can we be liable for injury, disappearance, death or fines of pet(s) with access to the outdoors.

Waiver of Liability
THIS IS A WAIVER AND RELEASE OF LIABILITY, HOLD HARMLESS AND COVENANT NOT TO SUE AGREEMENT. PLEASE READ THOROUGHLY. ASK ANY QUESTIONS BEFORE SIGNING, AND RETAIN A COPY. YOUR SIGNATURE ACKNOWLEDGES THAT YOU FULLY UNDERSTAND THE TERMS OF THE AGREEMENT, BELIEVE IT IS FAIR AND REASONABLE, AND AGREE TO ITS TERMS. DO NOT SIGN IF YOU DO NOT UNDERSTAND OR DO NOT AGREE WITH ITS TERMS. YOUR SIGNATURE CONFIRMS THAT YOU ARE ALSO NOT AWARE OF ANY INCIDENTS IN WHICH YOUR DOG HAS SHOWN AGGRESSIVE, FIGHTING, OR BITING BEHAVIOR TOWARDS OTHER ANIMALS OR PEOPLE.
I understand that VIP Pet Services will be providing transportation for my dog(s). I acknowledge that allowing VIP Pet Services to transport my dog(s) involves risks of injury to my animals(s) during transport.
I understand the special risks of having my dog(s) in play groups and in dog pack hikes, as well as the risk of having my dog(s) around other dogs, people, cyclists, and wildlife. These risks include but are not limited to, insect bites, snake bites, ingesting of items causing harm, muscle strain from walking on trails or playing with other dogs, aggressive dogs, unpredictable behavior and lack of proper training, as well as the inexperience or irresponsibility of another dog owner who is completely unaffiliated with VIP Pet Services. I acknowledge that VIP Pet Services will take reasonable actions to minimize these risks, but I understand that it is not always possible for VIP Pet Services to prevent injuries that may occur during group activities and in outdoor places where wildlife & people who are members of the public may be. I understand that VIP Pet Services specializes in playgroups and hikes and strives to protect the safety of my dog(s), but that there are inherent risks involved that are out of VIP Pet Services control.
I will be responsible for the actions of my dog(s) if it causes any damage whatsoever, including but not limited to damage or injury to other dogs, people, or objects while in the care of VIP Pet Services. I understand and agree that VIP Pet Services is not responsible for any injury to or damage caused by my dog(s), while in the care of VIP Pet Services.
I warrant that my dog(s) is suitable to be in the care of VIP Pet Services and is not aggressive toward people or other animals. My dog(s) is obedient and capable of following instructions. I will immediately advise VIP Pet Services of any problems with my dog(s) that could affect its behavior, health, or suitability for group activities.
I understand that VIP Pet Services will recommend that all dogs be neutered and spayed prior to arrival.
I understand that all dogs participating in our group activities must be up to date on their vaccinations for rabies, DHLPP, and bordetella. Proof of vaccines must be put in our online system.
Dogs that are currently ill or injured are not permitted to join our playgroups or pack hikes. Owners certify by signing this application that their dog(s) are in good health.
In the event of illness or injury, I authorize VIP Pet Services to take my dog(s) to the nearest veterinarian. I agree to pay for all veterinary care required, in the opinion of the veterinarian. I will notify my veterinarian that VIP Pet Services will be caring for my dog(s) while I am away and leave my credit card on file with them. VIP Pet Services will contact me or my emergency contact at the telephone numbers listed on the 'Client Info' sheet. If the Owner/Emergency Contact cannot be reached, VIP Pet Services is permitted to make any necessary decisions regarding the health and wellbeing of my dog(s).
I acknowledge that having my dog(s) in the company and environment of other dogs may involve risks regarding the contraction of illness. I am fully aware and understand that regular vaccinations cannot completely guard against illness and disease, and that VIP Pet Services cannot in any way prevent, nor are they responsible for, any illness that my dog might contract.
I agree to indemnify and hold harmless VIP Pet Services, it's members, directors, officers, agents, managers, employees and subcontractors (the “Indemnified Parties”) from all current and future, foreseen and unforeseen actions, expenses, judgments, damages, claims, losses or liabilities of any kind, including those arising out of their negligence or carelessness, and including attorney fees incurred and in defending against any of the same, that may arise from or in connection with, my dogs participation with VIP Pet Services, including personal injuries or death to/of my dog(s).
